That is a big no no. It would require by law a judge's order. To get such order the FBI would have had to convince the judge that they had reasonable cause to belive the General was leaking US secrets. All the FBI had was suspicion that the General was having an affair and were worried, as you say, that he could be compromised. According to Judge napaitano, the onky other way to read the e-mail legally would be if Home land Security gave themselves approval, but they are onlu athorized to that under the patriot Act if they have reason to believe the General was a terroist. So, it is going to get very interesting before it is all over. There has always been dislike between the FBI and the CIA but as the judge said there use to be a wall. The CIA never stuck their nose in domestic issues and the FBI never stuck their nose in affairs outside of our borders.
